The Independence of the Judiciary in Lebanon: Effectiveness of International Technical Assistance Depends on Political Will

This report was prepared by Maharat Foundation with the objective of monitoring and assessing the developments within Lebanon's justice sector, particularly in light of the technical assistance provided by the international community and the advisory role of the Venice Commission on draft laws concerning the independence of the judicial and administrative courts.

 

Despite the technical  assistance from the international community, the key determinant remains the political will, necessary for implementing reforms within the justice sector. This effort encounters several challenges, including the ongoing economic crisis, political instability exacerbated by the absence of a president, and a lack of serious commitment to implementing international recommendations.

 

Given these significant challenges, Maharat Foundation has concluded this report with a series of recommendations designed to overcome these obstacles and promote substantive reforms within the justice sector, ultimately striving towards achieving judicial independence in Lebanon.

 

This report is part of a series of reports produced by Maharat Foundation to track the progress of reforms highlighted in the Lebanon Reform, Recovery and Reconstruction Framework (3RF) which is part of a comprehensive response to the massive explosion on the Port of Beirut on August 4, 2020, launched by the European Union (EU), the United Nations (UN) and the World Bank Group (WBG).
